Este sábado 22 de febrero se celebrará en Barcelona la asamblea estatal de las Plataformas de Afectados por la Hipoteca (PAH), en la que se esperan unas 400 personas. Tras la asamblea, celebraremos el 5º aniversario de la PAH. A la cita están convocadas las más de 200 PAH’s hoy existentes y aunque por motivos económicos no todas podrán acudir, de un modo u otro todas estarán presentes.

Más de 1000 desahucios parados. Se dice rápido. Más de 1000 personas realojadas por la Obra Social de La PAH. Miles de daciones en pago, condonaciones y alquileres sociales conseguidos en estos años, conquistados con gran esfuerzo, batallando caso a caso, semana tras semana, gracias a miles de heroínas y héroes anónimos que se dejan la piel en este movimiento. Da vértigo mirar hacia atrás y ver todo lo que hemos logrado: cosas que hace cinco años nos decían que eran imposibles. El respaldo de la opinión pública. Una Iniciativa Legislativa Popular (ILP) por la dación en pago y el alquiler social que recogió un millón y medio de firmas. El apoyo de los jueces, del Parlamento Europeo y hasta de Naciones Unidas. Nuestra denuncia ha llegado a la prensa internacional, desde el New York Times o la BBC hasta Al Jazeera, pasando por Japón, Rusia o Finlandia.

Sin embargo no podemos ser autocomplacientes. A pesar de todas las “pequeñas grandes victorias” de las PAH, aún no hemos logrado cambiar la ley en el sentido de los mínimos recogidos en la ILP. A pesar de llevar ya acumuladas quinientas mil ejecuciones hipotecarias, siguen aumentando los desahucios, con una banca rescatada y sobreprotegida por los poderes públicos. El sistema es estructuralmente corrupto y la puerta giratoria entre los ministerios y los consejos de administración no ha dejado de funcionar, a costa de aumentar la desigualdad y los recortes en servicios básicos. El robo y el expolio se han instalado oficialmente en nuestras administraciones, bajo la forma contemporánea de la esclavitud llamada “deuda”.

Eppur si muove. Aunque pueda sonar a provocación, o a ingenuidad, nos atrevemos a afirmar que la PAH ya ha ganado. Ha ganado porque ha logrado lo más difícil: romper la versión oficial que nos condenaba a la soledad, al miedo y a la fatalidad. Una sociedad deprimida y culpabilizada no se moviliza, y eso el poder lo sabe. Por eso nos repetían todo el día grandes mentiras como que “los españoles hemos vivido por encima de nuestras posibilidades”, “tenemos lo que nos merecemos”, “hay políticos corruptos porque en este país ya se sabe que todo el que puede roba” o el clásico “no hay alternativa”. Pero de repente, como en el cuento de Andersen, los niños empezamos a gritar “el rey está desnudo” y todo cambió. En alianza con otros colectivos y con el maravilloso efecto multiplicador del 15M, hemos gritado “no es una crisis, es una estafa”, y hemos demostrado que sí se puede: Que somos mayoría, y si nos organizamos, tenemos mucho más poder del que nos habían hecho creer.

En los últimos tiempos, distintas personas y colectivos nos han preguntado, ¿cuál es la receta de la PAH? Aquí no podemos extendernos, pero ahí van algunas ideas:

  • 1) crear espacios de experiencia compartida donde las personas realicen por sí mismas que sus problemas no son cuestiones individuales sino colectivas;
  • 2) el enfoque de derechos: se están vulnerando los derechos de todas y todos nosotros, y el estado está incumpliendo sus compromisos y obligaciones al permitir, o incluso ser cómplice, de la vulneración sistemática de derechos humanos;
  • 3) generar empoderamiento a través de herramientas que capaciten a la gente, de manera que podamos defendernos por nosotros mismos, sin tener que delegar en nadie;
  • 4) Solidaridad y apoyo mutuo, de manera que nunca nadie más se sienta sola/o;
  • 5) La PAH es un dispositivo sencillo y fácil de replicar, con muy pocos requisitos: asambleario, apartidista e independiente, gratuito y pacífico. Quien quiera formar una PAH tiene todos los materiales necesarios en la web;
  • 6) una apuesta por la comunicación, en el sentido más amplio. La PAH quiere ser un instrumento real para la mayoría social afectada por la estafa hipotecaria, por lo que habla el lenguaje de la gente, y usa todos los medios posibles para comunicar, ya sean tradicionales o alternativos, así como las nuevas redes sociales;
  • 7) Una estrategia compleja, que articule objetivos a corto, medio y largo plazo, así como múltiples niveles: interpelación a las administraciones, acciones judiciales, incidencia internacional, acción directa y desobediencia civil como mecanismo de auto tutela de los derechos vulnerados.

Pero la PAH no es un episodio acabado, todo lo contrario: es un proceso abierto con múltiples retos. Por un lado retos internos: se trata de un movimiento popular que ha crecido mucho en muy poco tiempo, sin recursos, con múltiples urgencias y presiones. Ahora es tiempo de consolidar las PAH, y practicar la democracia siendo capaces de articular formas de organización grandes y complejas, a la vez que abiertas, horizontales y ágiles. Por otro lado, retos externos: frente al bloqueo institucional del PP, que ha abusado de su mayoría absoluta para despreciar el clamor ciudadano contra los desahucios, que no ha dudado en tratar de “filoterroristas” y “nazis” a quienes de forma pacífica reclamábamos algo tan básico como derechos humanos y democracia… ¿qué hacer?

  • De entrada, a) “romper por abajo”, una campaña que persigue convertir el rodillo de la mayoría absoluta del Partido Popular en un gigante con pies de barro. El gobierno difícilmente se moverá más de lo que se ha movido hasta que finalice la legislatura. Sin embargo las CCAA y los ayuntamientos, que hasta la fecha se han ido de rositas con la excusa de la pelota competencial, pueden hacer mucho más de lo que están haciendo. Pueden, entre otras cosas, expropiar pisos vacíos en manos de entidades financieras y penalizar fiscalmente su uso antisocial. Prueba de ello es el decreto andaluz o la ley foral de navarra 24/2013, suspendidas cautelarmente por un Tribunal Constitucional más politizado que nunca, tras un recurso interpuesto por el Gobierno. La reciente campaña de mociones promovida por las PAH en los ayuntamientos para multar pisos vacíos en manos de la banca, aprobada ya por 79 municipios catalanes en tan sólo un mes, apunta en esa dirección.
  • b) Extensión y práctica masiva de la desobediencia civil, que se inició en noviembre de 2010 con la campaña Stop Desahucios, y que ahora se expande a través de la Obra Social de la PAH, con 20 edificios recuperados y más de mil personas realojadas, así como otras campañas que están por venir;
  • c) acabar con la impunidad, ya sea por la vía judicial como persigue la campaña “Juicio y Castigo” para que los responsables de la estafa hipotecaria sean juzgados, o, cuando las leyes no permiten hacer justicia, por la vía del escrache y otras formas de protesta pacífica que permitan a la ciudadanía señalar a los responsables de la estafa y el expolio;
  • d) la construcción y el fomento de alternativas ya existentes, como el alquiler social y las cooperativas, la banca ética, las empresas de la economía social, y tantas otras que están demostrando que hay un mundo nuevo que empuja por nacer.

Cinco años después, quienes en febrero de 2009 empezamos la PAH en Barcelona, seguimos sin acostumbrarnos a la barbarie, y seguimos emocionándonos con cada victoria arrancada a la avaricia y la prepotencia de los bancos. En las PAH lloramos cada semana. Lloramos de rabia y dolor, cuando escuchamos los relatos de quienes acuden por primera vez a una asamblea y explican su vía crucis de meses sin dormir, de amenazas y presiones del banco, de tensión familiar, y de cosas aún peores. Pero lloramos cada vez más de alegría, escuchando a quienes no hace mucho llegaron derrotados y enmudecidos, y hoy explican a los nuevos que gracias a la PAH han logrado la dación o el alquiler social. Las PAH son un espacio rebosante de vida, donde cada día aprendemos, luchamos y nos sentimos como si fuéramos una familia. De hecho, en nuestras acciones y asambleas siempre haya niñas y niños correteando. Y que así sea siempre. Ellas y ellos más que nadie nos recuerdan que el horizonte está abierto y la historia por escribir.

Gracias a todas las PAH, por conquistar la esperanza y devolvernos el futuro.

The PAH has already won

On Saturday, February 22nd, the Platform for People Affected by Mortgages (PAH) will hold its countrywide assembly in Barcelona with more than 400 participants. The PAH will also be celebrating its 5th founding anniversary. The more than 200 PAH nodes across Spain are invited to the meeting. Though some of them won’t be able to physically be in Barcelona due to economic reasons, one way or another, they will all be present.
More than 1,000 evictions stopped. Sounds easy when said fast. Over a 1,000 people rehoused through the PAH’s Obra Social. Thousands of people have cancelled their mortgage debt after foreclosure1, been granted debt forgiveness for homes already repossessed, and obtained social housing in the millions of empty houses that banks collect in Spain. This has been accomplished thanks to great effort, fighting each family’s case, week by week, thanks to thousands of anonymous heroes and heroines who put their heart and souls into this movement . Looking back on all that has been accomplished is breath-taking. Five years ago, many of these things were unthinkable: General public’s full support, a People’s Legislative Initiative (ILP) to change Spain’s draconian mortgage laws signed by over a million and a half citizens, the backing of our demands by thousands of judges across Spain, even the European Parliament and the United Nations have backed us up. What we are denouncing has reached the international press, from New York Times or BBC, to Al Jazeera and places from Japan, to Russia or Finland.

But we cannot be complacent. Despite all our “small big victories,” we have yet to change the law to include at least the minimum requirements the PAH made through its ILP. Over five hundred thousand mortgage foreclosure processes have been issued throughout Spain and evictions continue to increase at the hands of a bailed-out banking system shielded and sheltered by government. The system is structurally corrupt and the revolving door between cabinet ministers and high-profile administrative councils hasn’t ceased to work. In exchange inequality has sharply increased and we’ve seen nothing but heavy spending cuts in basic services. Theft and looting have officially been installed in our government, under the contemporary form of slavery called “debt.”

Eppur si muove. It may sound like a provocation, or maybe naiveté, but we dare to say that the PAH has already won. It has won because it has accomplished the most difficult task: break with the hegemonic discourse that condemned people to solitude, fear and fatality. A depressed and shamed society doesn’t mobilize, and power knows this. It is precisely why they repeated nonstop the biggest lies about “Spanish people have lived beyond their means,” “we have what we deserve,” “there are corrupt politicians because in this country it is well known that whoever can rob will do so” or a classic “there is no alternative.” But all of a sudden, just like in Andersen’s story, children started yelling “the king is naked” and everything changes. In alliance with other collectives and with the wonderful multiplying support of the 15M, we have changed the message “it is not a crisis, it is a scam.” We have demonstrated that it is possible, that Yes! We can, we are the majority, and if we organize, we have much more power than they’ve made us believe.

In recent times, different people and social collectives have asked us what is the recipe for the PAH’s success? Without going into detail, here are a few ideas of what’s worked for us:

  • 1) The creation of social spaces for sharing day-to-day experiences, where people come to realize by themselves that their problems are not individual but collective issues;
  • 2) The focus on rights: they are violating the rights of each and all of us, and the state is reneging on its commitments and obligations by allowing, or even complicity, of the systematic violation of human rights;
  • 3) Generating empowerment through tools that equip people with knowledge so that we can all defend ourselves without having to delegate to anyone;
  • 4) Solidarity and mutual support, so that no one will ever have to feel alone;
  • 5) The PAH is a simple and easy-to-replicate mechanism, with very few requirements: people-powered, nonpartisan and independent, free of charge and non-violent. Who ever may want to create a PAH has all needed materials on our website;
  • 6) A commitment to communication, in its broadest sense. The PAH wants to be a genuine tool for everyone affected by mortgage fraud, so it speaks the language of the people and uses all possible means to communicate, whether traditional or alternative media, as well as new social networks;
  • 7) A complex strategy, with short, medium and long-term goals as well as a multiple-levelled approach. Interpellating public administrations, judicial procedures, international advocacy, direct action and civil disobedience as means of defending our rights.

But the PAH is a work-in-progress, it is a growing process with multiple challenges. On the one hand internal challenges: it is a grassroots movement that has grown very quickly, without resources, with multiple urgent needs and pressures. Now is the time to consolidate the PAH, and practice democracy by articulating large and complex forms of organization, that are open, horizontal and agile. On the other hand, external challenges: in light of the Popular Party’s (PP) institutional deadlock through its abused of absolute majority in congress and by ignoring citizen’s outcry against evictions, a PP who has not hesitated to call “filo-terrorists” and “Nazis” those who were demanding peacefully something as basic as human rights and democracy… what shall we do? For starters,

  • a) “by breaking from below”, a campaign that seeks to turn the Popular Party’s absolute majority into a giant with feet of clay. The government will hardly change its political posture from now till the end of their legislature. However, the Autonomous Communities and municipalities in Spain have to date gone scot-free with the excuse of regional versus national competencies, when in fact they can do much more than they are doing. They can, among other things, expropriate empty flats in the hands of financial institutions and fiscally penalize their lack of social use. Proof of this is the decree of Andalusia or the statutory law of Navarra 24/2013, provisionally suspended by a highly politicized Constitutional Court, following an appeal from the national government. The recent motions the PAH has put forward in various municipalities in order to fine all empty flats in the hands of banks; this has already been approved by 79 Catalan municipalities in just a month are all a sign of a work in the right direction.
  • b) Increased and continued mass civil disobedience, which began in November 2010 with the Stop Evictions campaign, and now expands through the PAH’s Obra Social, which has 20 buildings recovered from the hands of banking institutions and has rehoused more than thousand people, in addition to more campaigns to come;
  • c) Ending impunity, either through lawsuits, with the “Trial and Punishment” campaign by calling those responsible for the mortgage scam to be prosecuted, or through the ‘escrache’ campaign as well as other forms of peaceful protesting that allow citizens to identify those responsible for fraud and spoliation;
  • d) The construction and promotion of existing alternatives such as rental and cooperative social renting, ethical banking, stimulating a social economy, and many others that are showing that there are new and different alternatives waiting to spring.
  • Five years later, those who in 2009 started the PAH in Barcelona, are still not used to this barbarity, we continue to thrill with each victory ripped from greedy and prepotent financial system. At the PAH, we cry every week, of rage and pain when we hear the stories of those who step into our assemblies for the first time and explain their ordeal of months without sleep, threats and pressures from the bank, family stress, and worse. But increasingly we cry of joy; watching the transformation of those who not-long-ago seemed defeated and subdued are nowadays those who explain to newcomers what they have achieved thanks to the PAH, be it debt liberation after repossession and/or social rent. The PAH is an overflowing and lively space, where each day we learn, we fight and we feel like we were a family. In fact, in our daily actions and meetings there are always children running around. And that’s the way we want it to be. They are, more than anyone, the ones who remind us that our horizon is open and our history is still to be written.

    Sois la admiracion de este pais, que por cierto esta todavia muy quieto y no sabe lo que le viene encima, y ya le ha venido, pobreza, recortes sociales, retroceso en democracia…vamos ya casi no queda mas que el pataleo y todos deberiamos salir como vosotros a la calle y deci!!r BASTA YA!!
